Unpaid wage claims often stem from willful or unwitting misclassification of exempt and non-exempt employees. Generally, a “non-exempt” employee is not exempt from the provisions of federal and state compensation law. For example, such employees must be paid minimum wage for up to 40 hours of work per week or 8 hours per day. When these work hours are exceeded, the employee must receive overtime pay for each additional hour. Exempt employees are salaried, not subject to a 40-hour workweek and are not required to receive overtime pay. (This is a summary and simplification of a complex body of law.)
